What we handle
We act for claimants and defendants, at first instance and on appeal.
Claims for breach, damages and specific performance under supply, distribution, agency, construction, loan and service agreements.
Boardroom and shareholder disputes, minority protection, petitions for unfairly prejudicial conduct and derivative actions.
Interim and interlocutory injunctions, including freezing (Mareva) orders where assets are at risk of being moved.
Claims against those who have misappropriated funds, tracing of money and recovery of assets.
Disputes between banks and customers over debits, guarantees, security and the conduct of accounts.
Prosecuting and defending appeals at the Court of Appeal and the Supreme Court.
How a dispute proceeds
Every case is different, but most commercial disputes follow this course.
We review the documents, the merits and the other side's assets.
A letter before action and any steps the court's rules require before filing.
Filing the claim and seeking urgent relief where it is needed.
Using a summary procedure where the claim allows, or taking the case to trial.
Enforcing the judgment, or taking or defending an appeal.
Choosing the forum
Where a dispute is heard affects its speed, its procedure and how the judgment can be enforced. The Federal High Court has exclusive jurisdiction over many company law and banking regulation matters, while most contract claims between private parties belong in the State High Courts.
We advise on the right forum at the start, because a claim filed in the wrong court can be struck out after months of work.
The High Court of Lagos State expects parties to show what they did to resolve a dispute before filing, so the letter before action matters.
Claims become time-barred after a fixed period, commonly six years for simple contract claims. Delay can end a good claim.
Many disputes resolve through negotiation or mediation, including at the Lagos Multi-Door Courthouse. We advise on when settlement serves you better than trial.
